THE Government of Guyana will soon be examining the likelihood of signing onto the Hague Convention, to ensure that justice can be obtained in a wider range of family related issues, when the Family Court commences its work.
Minister of Legal Affairs and Attorney General Basil Williams explained that this move would be a strategic one for Guyana given is geographic location.
“We are a cross border country…our people live in Brazil, Suriname and Venezuela and establish relationships… you find a child comes back to Guyana with its mother (and) usually the husband follows and claims the child was abducted…hosting a Hague Conference on family law which deals with the private international aspects in cross border countries would be beneficial to us,” Minister Williams explained.

The long-awaited Family Court seems closer to being operationalised.
Attorney General and Legal Affairs Minister Basil Williams on Monday said he had spoken to the Chancellor who was in the “process of fine-tuning the rules”. The AG added that two Judges have been selected and there was a need for the establishment of a registry. Furthermore, he posited that whenever the rules are presented to him, his Office will be ready for the necessary implementation.
The Attorney General, who was meeting with the new Head of Delegation of the European Union to Guyana Ambassador, Jernej Videticon, is of the view that there should be a Hague conference on family law and private international aspects for ‘cross border’ countries like Guyana.

Court has no authority to proceed on motion challenging Technocrat Ministers – AG

Minister of Legal Affairs and Attorney General, Basil Williams has noted that the High Court lacks the necessary jurisdiction to proceed on a motion filed by former Attorney General, Anil Nandlall, which challenges the Technocratic Status of two government ministers.
The motion, which was filed early July in the High Court by People’s Progressive Party Civic (PPPC) candidate Desmond Morian, challenges the parliamentary status of the Minister within the Ministry of Communities, Keith Scott and Minister of Citizenship, Winston Felix and asserts that they do not fit the criteria of becoming parliamentarians.
According to GINA, Minister Williams explained to the Court that, 163 (1) (a) of the Guyana Constitution clearly establishes that for the High Court to hear such a proceeding it must be brought before the Court by way of an election petition rather than a motion.
